PRIVACY POLICY
The Soap Arcade adopts a strict policy of protecting your privacy. Any information we collect about you during an online sales transaction or when enquiring about our products, will be used lawfully (in accordance with the Data Protection Act 1998) and according to the regulations laid down by the Department of Trade and Industry relating to remote selling.

Once an official order is with us, we schedule a manufacturing slot in our calendar. We operate a strict policy of manufactering all orders in strict rotation in the order they were received. Once manufacturing is underway, the Soap Arcade will then contact you with a firm completion date.

TERMS AND CONDITIONS OF SALE (FOR UK WHOLESALE CUSTOMERS)
GENERAL CONDITIONS
The General Conditions of Sale shall apply to all offer, sales agreements and deliveries, unless both parties have otherwise agreed in writing.

INQUIRY, PRICES & ACCEPTANCE
These conditions of Sale are the only wholesale terms and conditions upon which The Soap Arcade sells or supplies goods. No order or quotation is binding unless The Soap Arcade issues an acknowledgement of the order.
Acceptance of an order by The Soap Arcade is subject to its rights to inquire within a reasonable time, into the Buyer's financial or trade status and in light of any report received to rescind the contract in which The Soap Arcade shall not be liable to make payment to the Buyer by way of compensation or damages.
All prices quoted are on the basis of final confirmation at time of order. The Soap Arcade reserves the right to alter prices and will advise any changes at the time of order.
The Soap Arcade reserves the right to decline or defer supply of any or all products.
Prices quoted will be on a specified basis as regards delivery where appropriate unless otherwise stated.
Unless otherwise stated all prices are in UK pounds sterling.
DELIVERY/ACCEPTANCE
The Soap Arcade undertakes and warrants to deliver goods in good order and condition up to the point of delivery/collection specified in the pricing terms.
Unless otherwise agreed in writing the delivery of the goods shall have taken place when the goods are removed from the vehicle at the specified address.
Any vehicle, ship or container provided by the Buyer to receive the goods must be of adequate size and must comply with all relevant legislation and regulations normally observed by The Soap Arcade. The Soap Arcade accepts no responsibility for the suitability or condition of any such vehicle, ship or container.
Delivery dates specified by The Soap Arcade are only estimates and if The Soap Arcade delivers the goods in more than one consignment the Buyer shall not for that reason be entitled to refuse any or all of the consignment.
The Buyer shall inspect the goods within 3 days after delivery and unless the Buyer gives notice in writing within that period to The Soap Arcade, specifying any defect in or proper objection to the goods. It shall be presumed that the Buyer has examined the goods and found them to be complete and in accordance with their order and are in good condition and fit for purpose for which they are required.
The right of the Buyer to offset the value of any short or defective goods or goods not conforming to contract shall be restricted to the specific invoice for the goods in question and shall not apply to previous or future accounts.
CANCELLATION
The Soap Arcade have the right to accept cancellation of an order by the Buyer but in the event of cancellation shall be entitled to charge for all work carried out or expenses incurred in relation to the order before such acceptance. The contract shall be considered to be valid at the time of firm order either written or verbal.
QUALITY/CLAIMS
The Soap Arcade undertakes and warrants delivering goods of an agreed and merchantable quality.
Notwithstanding any statutory obligations The Soap Arcade operates an unconditional policy to accept return of goods provided:
The Buyer is obliged to check the goods delivered before using or reselling them and in particular this check will have to refer to the state and identity of the goods delivered with reference to the goods sold. If the Buyer cannot prove having executed this check, he/she will have forfeited any right to claims.
The Soap Arcade reserve the right to replace or credit the value of the goods returned at our discretion. The cost of return carriage will generally be at the Buyers cost.
The Soap Arcade reserves the right to make a charge on a discretionary basis for the handling of return goods where there is no apparent cause for return as a result of quality or non-conformance.
PRODUCT SPECIFICATION/HEALTH & SAFETY DATA
The Soap Arcade gives notice that it will upon the buyers request; provide data/specification/certification and health and safety data, necessary to inform the Buyer of the general characteristics and specific risks in handling its products.
SUITABILITY
The Soap Arcade will endeavour to the best of its abilities to provide products appropriate to the Buyers needs however, the Buyer should satisfy itself as to the ultimate suitability for the intended application and the products conformity to any legal requirements when used in the way intended. No liability is accepted in respect of any reputed therapeutic characteristic.
LIABILITY
The Soap Arcade limits its liability in ordinary circumstances to the cost only of the goods supplied or the replacement of the same. The Buyer shall attempt to minimise any such liability in the event of a claim.
The Soap Arcade shall not be liable or held responsible for any claim in excess of the limits of its Liability Insurance that is in place at the time.
The Soap Arcade shall not be liable or held responsible to the Buyer any dealer or other person for the consequential loss damage or injury howsoever caused arising directly or indirectly from its negligence or wilful default or the negligence or wilful default of its employees or agents in any way whatsoever including in manufacturing processing packing or loading the goods or arising directly or indirectly from storage use or application of the goods.
PAYMENTS
The Buyer agrees to honour payment against presentation of a proforma invoice, and the payment terms stated on that invoice.
All costs, judicial as well as extra judicial, for The Soap Arcade, resulting from the Buyer not complying with any obligation for him/her from this agreement, will be completely to the account of the Buyer. Charges collected in an extra judicial way will at least amount to 15% of the main account. The fact that The Soap Arcade had to secure the help of a third party shows the liability in paying the extra judicial costs.
RESERVATION OF TITLE AND ASSIGN ABILITY
The Soap Arcade reserves title in full to the goods until such time as payment in full has been made and the Buyer shall hold goods such that The Soap Arcade can identify its title and legal ownership.
It is the responsibility of the Buyer to cover all potential loss situations after taking delivery.
Any contract entered into is not assignable by the Buyer without written consent of The Soap Arcade.
The Soap Arcade may at any time without notice recover possession of the goods, the property of The Soap Arcade, the buyer granting irrevocable licence to enter for that purpose any premises then occupied by the Buyer.
FORCE MAJEURE
Neither party shall be responsible for any failure to fulfil any provision of this contract if such failure is caused by circumstances beyond the control of The Soap Arcade or Buyer as the case may be, or by, the shortage of supplies required for or in connection with the manufacture of a product or by compliance with any order or request of any national or local port or authority.
Where The Soap Arcade is delayed or hindered from delivering the goods for reasons above the order shall at the request of The Soap Arcade be varied to exclude those goods from the order and The Soap Arcade will not be liable in damages to the Buyer, nor may the Buyer cancel the order or refuse delivery of the other goods.
The contract shall at all times be subject to the usual considerations in respect of Force Majeure.
PROPER LAW
English Law shall ultimately govern any contract and both parties submit themselves to the non-exclusive jurisdiction of the English Courts.
ENTIRE AGREEMENT AND HEADINGS
Save as expressly agreed in writing these conditions embody all the terms binding between the Buyer and The Soap Arcade and replace all antecedent representations or proposals not embodied. Amendments hereto shall not come into operation until reduced to writing and properly executed on behalf of the Buyer and The Soap Arcade.
The heading of the paragraphs hereto are inserted for convenience and does not form part of the condition themselves.
